Why Make A Will?

By making a Will you can ensure that your property and affairs are dealt with in the way you would want. In making a Will you can also appoint Executors, who would be the person responsible for carrying out your wishes, appoint a guardian for any children under 18 and also give instructions as to the disposal of your remains.

 

It is especially important for those going through a divorce or separation to make or remake a Will. As in the absence of a suitable Will the estranged spouse/civil partner could well benefit.

 

A well thought out Will can and should, therefore, be more than a mere dividing up of your

Estate amongst relatives and friends. It can be a practical, thoughtful and carefully planned out document reflecting your concern for those closest to you. What Happens If I Do Not Make A Will?

If you die without having made a Will, then you will have died intestate and the general rules of

Intestacy will apply to your Estate rather than your own wishes. These rules could mean that your spouse/civil partner could receive only part of your Estate and that blood relatives with whom you had little or no contact during your lifetime could benefit rather than your friends or in-laws.

receiving any part of your Estate. To die intestate means not only causing a great deal of distress for those you leave behind, it could also cause hardship.

 

How Can I Go About Making A Will?

It is not expensive to make a Will, nor need it be complicated or time consuming. The important thing is that the job should be done properly. A home-made Will is quite often not worth the paper it is written on. A Solicitor can ensure that your Will expresses your wishes and is legally valid.

 

When Should An Existing Will Be Changed?

There are many reasons why you may need to change your Will after you have made it. The simple answer is that if there are any significant changes in your circumstances you should change or amend your existing Will.

 

The most obvious reason is a change in your family circumstances, such as marriage, separation, divorce or remarriage. Even if there is no change in your family circumstances, it makes sense to take a fresh look at your Will every few years. Ask yourself the following questions:

 

Are my assets worth considerably more or less than when I made my Will?

 

Does my Will reflect the current value of my property and possessions?

 

Does my Will still meet my wishes?

 

Can I, by changing my Will, reduce the amount of Inheritance Tax that will have to be paid on my Estate?
